  • Assessment Results: Retained for 3 years for validation and compliance purposes

7.2 Client Information

  • Active Clients: Information retained for duration of business relationship
  • Former Clients: Information retained for 7 years following last engagement (for financial, tax, and legal compliance)
  • Contracts and Agreements: Retained for 10 years after expiration or termination
  • Financial Records: Retained for 7 years per IRS and accounting standards

WHILE WE IMPLEMENT INDUSTRY-STANDARD SECURITY MEASURES, NO SYSTEM IS COMPLETELY SECURE. YOU ACKNOWLEDGE AND AGREE THAT: (A) INTERNET TRANSMISSION AND ELECTRONIC STORAGE ARE NOT 100% SECURE; (B) ALIVIO CANNOT GUARANTEE ABSOLUTE SECURITY OF YOUR INFORMATION; (C) ANY TRANSMISSION OF PERSONAL INFORMATION IS AT YOUR OWN RISK; AND (D) ALIVIO SHALL NOT BE LIABLE FOR ANY UNAUTHORIZED ACCESS, HACKING, DATA BREACHES, OR OTHER SECURITY INCIDENTS BEYOND OUR REASONABLE CONTROL, EXCEPT AS REQUIRED BY APPLICABLE LAW.

Alivio uses AI-powered technology, algorithms, and automated systems to assist with candidate evaluation, job matching, and recruitment processes. This may include:

  • Predictive analytics for candidate success probability
  • AI-generated candidate summaries and insights
  • Automated skills matching and job recommendations

You acknowledge that automated decision-making may be used in our recruitment processes. However, all final hiring decisions are made by human recruiters and employers, not solely by automated systems. 15. Data Breach Notification

In the event of a data breach that is reasonably likely to result in a risk to your rights and freedoms, we will notify affected individuals and relevant regulatory authorities as required by applicable law. Notifications will be made without undue delay and, where feasible, within 72 hours of becoming aware of the breach. Notifications will include the nature of the breach, categories of data affected, likely consequences, and measures taken to address the breach and mitigate harm.

17. Do Not Track Signals

Some web browsers have "Do Not Track" (DNT) features that signal websites you visit that you do not want to have your online activity tracked. Our Website does not currently respond to DNT signals or similar mechanisms. We will update this Privacy Policy if we implement DNT recognition in the future.

Alivio reserves the right to modify, amend, or update this Privacy Policy at any time, in our sole discretion. We will notify you of material changes by posting the updated policy on our Website with a new "Last Updated" date and, where required by law, by email or prominent notice on the Website. Your continued use of our Services following notification of changes constitutes your acceptance of the updated Privacy Policy. If you do not agree with any changes, you must discontinue use of our Services immediately. We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information.

19. Dispute Resolution and Arbitration

19.1 Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.

19.2 Exclusive Jurisdiction and Venue

Any disputes arising out of or related to this Privacy Policy, or the collection, use, or disclosure of your Personal Information, shall be subject to the exclusive jurisdiction of the state and federal courts located in Westchester County, New York, or New York County (Manhattan), New York. You hereby irrevocably consent and submit to the personal jurisdiction of such courts and waive any objection to venue in such courts based on inconvenient forum or otherwise.

19.3 Arbitration (Optional at Alivio's Sole Discretion)

Alivio may, at its sole and exclusive discretion, elect to resolve any dispute through binding arbitration rather than litigation. If Alivio elects arbitration:

  • Arbitration shall be conducted in Yonkers, NY or New York City, NY
  • Arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
  • The arbitrator's decision shall be final and binding
  • Each party shall bear its own costs, except that Alivio may elect to have you pay arbitration fees if you are the claimant
  • The arbitrator may award attorneys' fees and costs to the prevailing party

19.4 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

19.5 Prevailing Party Attorneys' Fees

In any dispute arising from this Privacy Policy, the prevailing party shall be entitled to recover reasonable attorneys' fees, costs, and expenses, including expert witness fees and litigation costs.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALIVIO'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY OR OUR DATA PRACTICES SHALL NOT EXCEED FIVE THOUSAND DOLLARS ($5,000.00). ALIVIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

21. Severability

If any provision of this Privacy Policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from this Privacy Policy. The remaining provisions shall continue in full force and effect.
